Office Memorandum

Subject:- The Central Government’s decision on recommendations of the 7th CPC on allowance payment to Pensioners: revised Fixed Medical Allowance and Constant Attendance Allowance on 100% disablement regarding.

Attention is invited to Ministry of Finance, Department of Expenditure Resolution No.11-1/2016-IC dated-6th July, 2017 on the above subject whereby it has been decided to revise the existing rates of following allowances for Pensioners:
These revised rates are payable w.e.f. 01.07.2017.

In view of the above, Heads of CPPCs/Government Business Departments of all the banks are requested to arrange to credit the pensions/family pensions to the bank accounts from the month of July, 2017 onwards, for the respective pensioners who are already being paid above allowances, with the revised rates without waiting for any specific/separate authority from CPAO for such Pensioners.

This issues with the approval of the competent authority.

OFFICE MEMORANDUM

Subject: Extension of time limit for forwarding of 7th CPC-related anomalies by the Staff-Side, NC(JCM) and for their disposal by the National Anomaly Committee – regarding

The undersigned is directed to refer to the aforementioned subject and to say that in further partial modification of this Department’s O.M. of even no. dated 5th May, 2017, it has been decided to extend the time limits for both receipt and disposal of the 7th CPC-related anomalies, as per the following details:

(i) The time limit for receipt of anomalies will stand extended by three months from 15.05.2017(as notified vide O.M. referred to above) to 15.08.2017; and

(ii) The time limit for disposal of anomalies will stand extended by three months from 15.11.2017 (as notified vide O.M. referred to above) to 15.02.2018.

2. This issues with the concurrence of Department of Expenditure, Ministry of Finance.

RESOLUTION

It is announced for general information that during the year 2017-2018, accumulations at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 7.8% (Seven point eight per cent) w.e.f. 1st July, 2017 to 30th September, 2017. This rate will be in force w.e.f. 1st July, 2017. The funds concerned are:-

1. The General Provident Fund (Central Services).
2. The Contributory Provident Fund (India).
3. The All India Services Provident Fund.
4. The State Railway Provident Fund.
5. The General Provident Fund (Defence Services).
6. The Indian Ordnance Department Provident Fund.
7. The Indian Ordnance Factories Workmen’s Provident Fund.
8. The Indian Naval Dockyard Workmen’s Provident Fund.
9. The Defence Services Officers Provident Fund.
10. The Armed Forces Personnel Provident Fund.

2. Ordered that the Resolution be published in Gazette of India.

IMPLEMENTATION OF RECOMMENDATIONS OF SEVENTH CPC

QUESTION
257 SHRI NEERAJ SHEKHAR:

Will the Minister of FINANCE be pleased to satate:

(a) whether Government has implemented the recommendations of Seventh CPC regarding allowances w.e.f. 1 July, 2017 instead of 1 January, 2016;

(b) if so, the reasons and rationale therefor;

(c) the reasons for denying allowances from 1st January 2016 or from the date of announcement for implementation of enhanced basic pay under 7th CPC and arrears thereof;

(d) whether Government will review it and implement enhanced allowances w.e.f. 1 January, 2016;

(e) if so, the details thereof; and

(f) if not, the reasons therefor along with the reasons for lowest hike in Pay Commission since last 70 years?

(a) to (c): As per the established practice relating to implementation of earlier Central Pay Commission’s recommendations on allowances, the recommendations of the Seventh Central Pay Commission (7th CPC) on allowances have been implemented prospectively with effect from 01.07.2017.

In view of significant departure from the existing provisions relating to allowances as recommended by the 7th CPC and representations received in this regard, recommendations of the 7th CPC on allowances were referred to a Committee by the Government. After taking into account the recommendations of the Committee on Allowances which submitted its Report on 27.04.2017, the recommendations were approved by the Government on 28.06.2017.

(d) to (f): There is no proposal for revision of the date of implementation of recommendation on allowances. The hike is based on the recommendation of the 7th CPC on allowances, which is commensurate with the rise in Dearness Allowance as has been mentioned by the 7th CPC at Para 8.2.5 (4) of its Report.

Subject: Implementation on the recommendations of 7th Central Pay Commission – Grant of Island Special Duty Allowance to the Central Government employees posted in the Andaman & Nicobar Group of islands and Islands of Union Territory of Lakshadweep

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission by the Government, the President, in Supersession of all existing orders issued on the subject from time to time, is pleased to decide that Central Government employees posted in the Andaman & Nicobar (A&N) Group of islands and Islands of Union Territory of Lakshadweep, shall be paid Island Special Duty Allowance at the following rates:-
2. The term ‘Basic Pay in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix but does not include any other type of pay like Special Pay, etc.

3. Island Special Duty Allowance shall not be admissible during the periods of leaves training/tour etc. beyond full calendar month (s), in case, the employee is outside the Andaman & Nicobar Group of islands and Islands of Union Territory of Lakshadweep. The allowance shall not be admissible during suspension and joining time,

4. Island Special Duty Allowance shall be admissible in addition to Hard Area Allowance, where admissible. In places where more than one Special Compensatory Allowances are admissible, the Central Government employees posted in such stations will have the option to choose the allowance which benefits them the most, i.e., Hard Area Allowance or one of the Special Compensatory Allowances subsumed under Tough Location Allowance Category-l, land III.

5. The Orders shall take effect from 1st July, 2017.

6, These Orders shall also apply to the civilian employees paid from the Defence Services Estimates and the
expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces
personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively,

7. In so far as the employees working In the Indian Audit and Accounts Department are concerned, these Orders are issued with the concurrence of the Comptroller and Auditor General of India.

Subject: Implementation of the recommendations of the 7th Central Pay Commission Grant of Special Duty Allowance for the Central Government employees serving in the North Eastern Region and Ladakh.

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission by the Government the President, in supersession of ali existing orders issued on the subject from time to time, is pleased to decide that Central Government employees serving in the North Eastern Region and Ladakh, shall be paid Special Duty Allowance (SDA) at the rate of 10% of Basic Pay.

2. The term ‘Basic Pay’ in the revised pay structure means the pay drawn in the prescribed Levels in the Pay Matrix but does not include any other type of pay like Special Pay, etc.

3. Special Duty Allowance will not be admissible along with Tough Location Allowance, Employees will have the additional option to avail of the benefit of Special Compensatory (Remote Locality) Allowance (SCRLA) as per 6th Central Pay Commission rates along with Special Duty Alowance at revised rates.

4. Special Duty Allowance shall not be admissible during the periods of leave/training/tour etc. beyond full calendar month(s), in case, the employee is outside the North„Eastern Region and Ladakh during leave/training/tour etc. I T he allowance shall not be admissible during suspension and joining time.

5. These orders shall take effect from 1 st July, 2017.

6. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. Subject: – Guidelines on Air Travel on Official Tours — Purchase of air ticket from authorized agent.

The undersigned is directed to refer to this Departments’ Q.M. No. 19024/1/2005-E.IV dated 24.03.2006, Q.M. No. 19024/1/2009-E.ly dated 16.09.2010 and D.M. No. 19024/1/2012-E.IV dated 09.07.2013 regarding guidelines on Air travel. As per these guidelines, in all cases of Air Travel where the Government of India bears the cost of air passage, Air Tickets may be purchased directly from Airlines (at Booking counters/office/Website of Airlines) and if needed, by utilizing the services of three Authorized Travel Agents viz, M/s Balmer Lawrie & Company Limited (BLCL), M/s Ashok Travels & Tours (ATT) and Indian Railways Catering and Tourism Corporation Ltd. (IRCTC).

2. This Department is receiving a large number of proposals from various Ministries/Departments seeking ex- post-facto relaxation of the prescribed procedure for purchase of air tickets from authorized travel agents only.

LTC Air travel guidelines3. The matter has been reconsidered in this Department. All Ministries/Departments are again directed to:

(i) Ensure strict compliance of extant guidelines for purchase of air ticket directly from Airlines (at Booking counters/office/Website of Airlines) or from three authorized Travel Agents viz. M/s Balmer Lawrie & Company Limited, M/s Ashok Travels & Tours and IRCTC only by all officials/offices under their control. Henceforth relaxation on account of ignorance/unawareness of these guidelines will not be considered by this Department.

ii) In case of non-availability of authorized agent at a particular place, ticket may be booked from website of Airlines or web portal of Balmer Lawrie & Company Ltd., M/s Ashok Travels & Tours and IRCTC.

iii) In respect of Non-officials of Committees/Boards/Panels, the concerned Ministry/Department have to mention in the meeting notice that the Non-official Member has to purchase the ticket from authorized travel agent only otherwise his claim will not be settled by that Ministry/Department.

iv) All Ministries/Departments of the Government of India, etc. have to widely circulate this O.M. in all offices including attached/subordinate offices/ autonomous bodies under their control with specific instructions to Heads of Departments concerned for strict compliance of these guidelines. Non-compliance of these guidelines by Ministries/Departments will be treated as lapse on the part of the concerned Ministry/Department.

Military Nursing Service Pay Rules 2017 – Fixation of Pay Illustration

S.R.O. (E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules, namely:-

1 .Short title and commencement:- (1) These rules may be called the Military Nursing Service Pay Rules, 2017.

(2) They shall be deemed to have come into force on the 1st day of January,2016.

2. Save as otherwise provided under these rules, these rules shall apply to all Officers in the Military Nursing Service, who were on the effective strength of their Service as on the 1st day of January, 2016, and those who join the service thereafter, and to trainee Officers who were undergoing pre-Commission training on the 1st day of January, 2016, and to those trainee Officers who join service after that date.

3.Definitions – In these rules, unless the context otherwise requires,-

a.”existing basic pay” means the pay drawn in the prescribed existing Pay Band and Grade Pay or pay in the existing scale, but does not include any other pay like Special Pay, Military Service Pay etc;

b.”existing Pay Band and Grade Pay” in relation to a Military Nursing Service Officer, means the Pay Band and the Grade Pay applicable to the rank held by the Officer as on the date immediately before the notification of these rules, in a substantive capacity;

c.”existing scale” in relation to a Military Nursing Service Officer, means the pay scale applicable to the rank held by the Officer on the date immediately before the notification of these rules;

Explanation.- For the purposes of these rules the expressions “existing Basic Pay”, “existing Pay Band and Grade Pay” and “existing scale”, in respect of a Military Nursing Service Officer who, on the 1st day of January, 2016, was on deputation out of Military Nursing Service or on leave or on foreign service, or who would have on that date officiated in one or more lower posts but for his officiating in the higher post, shall mean such Basic Pay, Pay Band and Grade Pay or scale in relation to the rank which he would have held but for his being on deputation out of Military Nursing Service or on leave or on foreign service or as the case may be, but for his officiating in that post;

d. “existing pay structure” in relation to a Military Nursing Service Officer, means the Pay Band and Grade Pay or the Pay Scale as per the Sixth Central Pay Commission applicable to the rank held by the Officer as on the date immediately before the coming into force of these rules, in a substantive capacity;

e. “existing Military Service Pay” in relation to a Military Nursing Service Officer, means the amount of Military Service Pay applicable to the rank held by him on the date immediately before coming into force of these rules;

f.”existing emoluments” means the sum of (i) existing basic pay; (ii) existing Military Service Pay; and (iii)existing dearness allowance at the index average as on 1st day of January, 2016;

g.”Pay Matrix” means the Matrix specified in Part A of the Schedule, with Levels of pay arranged in vertical Cells as assigned to corresponding Pay Band and Grade Pay or scale;

Note.- In any kind of calculation which attempts to work with the maximum pay of a particular level the last figure of the Level shall not be calculated and the end-points of the Level, representing the possible highest and lowest pay in that level, may not be treated as the maximum and minimum of any closed pay scale, as used to prevail prior to the implementation of the Sixth Central Pay Commission;

h.”Level” in the Pay Matrix, means the Level corresponding to the existing Pay Band and Grade Pay or scale specified in the Part A of the Schedule;

i.”pay in the Level” means the pay drawn in the appropriate Cell of the Level as specified in Part A of the Schedule;

j.”Military Service Pay” in relation to a Military Nursing Service Officer means the Military Service Pay applicable to the rank held by him admissible on drawal of pay in the prescribed Level in the Pay Matrix;

k. “revised pay structure” in relation to a rank means the Pay Matrix and the Levels specified therein corresponding to the existing Pay Band and Grade Pay or scale of the rank;

l. “basic pay” in the revised pay structure means the pay drawn in the

prescribed Level in the Pay Matrix;

m.”revised emoluments” means the sum of (i) basic pay; and (ii) Military Service Pay; and.

n. “Schedule” means a Schedule annexed to these rules.

4.Level of Ranks— The Level of ranks shall be determined in accordance with the various Levels as assigned to the corresponding existing Pay Band and Grade Pay or scale as specified in the Pay Matrix. The Level in Pay Matrix corresponding to the rank of a Military Nursing Service Officer is specified in Part B of the Schedule.

5. Drawal of pay.- (1) Save as otherwise provided in these rules, an Officer shall draw pay in the Level in the revised pay structure applicable to the rank to which he is appointed in substantive capacity:

Provided that an Officer may elect to continue to draw pay in the existing pay structure, until the date on which he earns his next or any subsequent increment in the existing pay structure, or until he ceases to hold his rank or ceases to draw pay in the existing pay structure:

Provided further that in case an Officer has been placed in a higher grade pay or scale between the 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Officer may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.

Explanation.- (i) For the purpose of this clause the option to retain the existing pay structure under the provisos of this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.

(ii) The aforesaid option shall not be admissible to any Officer commissioned on or after the 1st day of January, 2016, and he shall be allowed pay only in the revised pay structure.

(2) (i) Military Service Pay is a compensation for the various intangible aspects linked to the special conditions of service in Army extended to Military Nursing Service Officers in the Military Nursing Service upto and including the rank of Brigadier.

ii) Military Service Pay shall be admissible to Military Nursing Service Officers on drawal of pay in the prescribed Level in the Pay Matrix, at the rate of Rs 10,800 per month

iii) Military Service Pay shall be counted as pay for the purpose of computation of dearness allowance and pension.

Military Nursing Service Pay Rules 20176. Exercise of option.- (1) The option under the provisos to rule 5 shall be exercised in writing in the form appended to these rules so as to reach the Principal Controller of Defence Accounts (Officers), Pune within one hundred and eighty days of the date of notification of these rules, or where revision in the existing pay structure is made by any order subsequent to the date of notification of these rules, within one hundred and eighty days of the date of such order:

Provided that,-

(i) in the case of a Military Nursing Service Officer who is, on the date of such notification or, as the case may be, date of such order, out of India on leave or deputation or foreign service or active service, the said option shall be exercised in writing so as to reach the Principal Controller of Defence Accounts (Officers) within one hundred and eighty days of the date of his taking charge of his post in India; and

(ii) where a Military Nursing Service Officer is under suspension on the 1st day of January, 2016, the option may be exercised within one hundred and eighty days of the date of his return to his duty, if that date is later than the date prescribed in this sub-rule.

2.The option, along with an undertaking in the form appended to these rules, shall be intimated by the Military Nursing Service Officer to the Principal Controller of Defence Accounts (Officers).

3. If the intimation regarding option is not received by the Principal Controller of Defence Accounts (Officers) within one hundred eighty days of the date of notification of these rules, the Military Nursing Service Officer shall be deemed to have elected to be governed by the revised pay structure with effect from the 1st day of January, 2016.

4. The option once exercised shall be final.

Note 1 – Military Nursing Service Officers whose services were terminated on or after the 1st day of January, 2016 and who could not exercise the option within the prescribed time limit, on account of discharge on the expiry of the sanctioned strength, release, resignation, dismissal or discharge on disciplinary grounds, are entitled to exercise option under sub-rule (1).

Note 2 – Military Nursing Service Officers who have died on or after the 1stday of January, 2016 and could not exercise the option within the prescribed time limit, are deemed to have opted for the revised pay structure on and from the 1st day of January, 2016 or such later date is beneficial to their dependents, if the revised pay structure is more favourable and in such cases, necessary action for payment of arrears shall be taken by the Principal Controller of Defence Accounts(Officers).

Note 3.- Military Nursing Service Officers who were on Annual Leave or any other leave on the 1st day of January, 2016, which entitled them to leave salary, shall be entitled to exercise option under sub-rule (1).

7. Fixation of Pay in the Revised Pay Structure.- (1) The pay of a Military Nursing Service Officer who elects, or is deemed to have elected under rule 6 to be governed by the revised pay structure on and from the 1st day of January, 2016, shall, unless in case the President by special order otherwise directs, be fixed in the following manner, namely:-

i. the pay in the applicable Level in the Pay Matrix shall be the pay obtained by multiplying the existing basic pay by a factor of 2.57, rounded off to the nearest rupee, and the figure so arrived at shall be located in that Level in the Pay Matrix, and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.

ii.if the minimum pay or the first Cell in the applicable Level is more than the amount arrived at as per clause (i), the pay shall be fixed at the minimum pay or the first Cell of that applicable Level.

Subject: Implementation of the recommendations Of 7b Central Pay HRA for civilian employees of the Central Government serving In the States of North Eastern Region, Andaman & Nicobar Islands, Lakshadweep Islands and
Ladakh.

Consequent upon revision of Of HRA granted to the Central  Government on implementation of the recommendations of 7th  Central Pay Commission vide 0M No. 2/5/2017 E.II(B)  dated 07.07.2017, in modification of this 0M. NO. dated 29.03.1984 and 0M. No. 2(19)/E.II(B)/2008 02.01.2009 on the subject mentioned above, additional HRA shall be granted to the civilian Employees of Central Government  posted to States of North Eastern Region, Andaman Nicobar Islands, Lakshadweep Islands and Ladakh, who have their families at their duty station at revised rates per OM. No. 2/5/2017-E.II(B) dated  07.07.2017.

Additional HRA to CG Employees working in NER, A and N, Lakshadweep and Ladakh2. These orders, will not applicable such employees who  were transferred out of North  Eastern Region, Andaman & Nicobar Islands and Lakshadweep Islands and ladakh before 1.7.2017.

3.These orders shall take effect from 1st  July,2017

4.These orders shall ab to the civilian employees paid from the Defence Estimates and the expenditure will be chargeable to the relevant head of the Defence Estimates. In regard to Armed Forces personnel and  Railway Employees separate orders will be issued  by the Ministry Of Defence and Ministry of Railways, respectively.

5.In so far as the employees working in the Indian Audit and Accounts Department are  concerned, these orders are issued with fre concurrence of the Comptroller and Auditor General of India.

Consequent upon the acceptance of the recommendation of the seventh pay commission and in supersession of this department OM No.19039/2/2008-E.IV dated 23rd September 2008 the President is pleased to revise the rates of Fixed Conveyance Allowance Admissible under SR-25 to Central Government Employees as indicated below:

2.These rates shall automatically increase by 25% whenever the Dearness allowance on the revised pay structure goes upto by 50%

Subject:- Implementation of the recommendations of 7th Central Pay Commission – Grant of Special Compensatory Allowances subsumed under Tough Location Allowance.

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission, in supersession of the existing orders for grant of Special Compensatory Allowances viz. Special Compensatory (Remote Locality) Allowance, Bad Climate Allowance, Special Compensatory Scheduled/Tribal Area Allowance and Sunderban Allowance which have been subsumed in Tough Location Allowance, the President is pleased to decide the rates of these Special Compensatory Allowances (subsumed in Tough Location Allowance) to Central Government employees as under :
2.These rates shall increase by 25 per cent whenever the Dearness Allowance payable on the revised pay
structure goes up by 50 per cent.

3.The term ‘Pay Level’ in the revised pay structure means the ‘Level in the Pay Matrix.

4.In respect of those employees who opt to continue in their pre-revised pay structure/Pay scales, the corresponding Level in the Pay Matrix of the post occupied on 01.01.2016 as indicated in GCS (Revised Pay) Rules, 2016 would determine the allowance under these orders.

5.Sunderban Allowance categorised ‘as Tough Location Allowance-III shall be admissible to the Central Government civilian employees working in Sunderban areas South of Dampier Hodge’s line, namely, Bhagatush Khali (Rampura), Kumirmari (Bagna), Jhinga Khali, Sajnakhali, Gosaba, Amlamathi (Bidya), Canning, KuKali, Piyali, Nalgaraha, Raidighi, Bhanchi, Pathar Paratima, Bhagabatpur, Saptamukhi, Namkhana, Sikarpur, Kakdwip, Sagar, Mousini, Kalinagar, Haroa, Hingalganj, Basanti, Kuemari, Kultola, Ghusighata (Kulti) area. The allowance shall be admissible only upto the period for which the. Government of West Bengal continues to pay this allowance to its employees.

6.Scheduled/Tribal Area Allowance and Bad Climate Allowance categorised as Tough ‘Location Allowance-III shall be admissible only in those States where Scheduled/Tribal Area Allowance and Bad Climate :Allowance are admissible and shall be discontinued in those States where it has been discontinued for the State Government employees with effect from the date(s) of such discontinuance.

7.In the event of a place falling In more than one category, the higher rate of Tough Location Allowance will be applicable.

8.Tough Location Allowances shall not be admissible along with Special Duty Allowance. However, employees have the option for continuing Special Compensatory (Remote Locality) Allowance at old rates of 6th CPC, where it was admissible, along with Special Duty Allowance at revised rate of 10% of Basic Pay,

9 Employees may exercise their option to choose either Hard Area Allowance which is admissible alongwith Island Special Duty Allowance or one of the Special Compensatory Allowance, subsumed under Tough Location Allowance as mentioned in Para 1 above,

10.These orders take effect from 1st July, 2017.

11.These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of. the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

12.In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission by the Government, the President, is pleased to decide that, in modification of this Ministry’s -O.M. No.20011/5/73-E.II(B) dated.17.01.1975 as amended from time to time and OM. No.6(3)/2008-E.II(B) dated 29.08.2008 on the subject mentioned above, the Central Government employees shall be paid Project Allowance, which has been covered in the Risk/Hardship Matrix, at the following revised rates:-

3. The term ‘Pay Level’ in the revised pay structure means the ‘Level in the Pay Matrix.

4. In respect of those employees who opt to continue in their pre-revised pay- structure, corresponding Grade Pay in the prescribed pay band as indicated in CCS(Revised) Pay) Rules, 2016 would determine the allowance under these orders.

5. These rates shall increase by 25 per cent whenever the Dearness Allowance payable on the revised pay structure goes up by 50 per cent.

6. All other terms and conditions governing the grant of this allowance shall remain unchanged.

7 These orders shall take effect from 1st July, 2017.

8. These orders shall also apply to the. civilian employees paid from the Defence Services Estimates and the expenditure will be charge-able to the relevant head of the Defence Services Estimates in regard to Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

9. In so far as the employees. working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Inclusion of more Govt Holidays in National Calendar

The Government has received proposal to make Patriots Day, observed on 13th August, and Ningol Chakkouba, which coincides with Bhai Duj, as restricted holidays and include them in the National Calendar.

As per existing policy, the Central Government administrative offices observe 17 holidays in a year. Out of these 17 holidays, 14 are pre-notified, compulsory holidays, which include three National holidays, namely, Republic Day, Independence Day and Mahatma Gandhi’s birthday. The remaining three holidays are required to be selected, by the Central Government Employees Welfare Coordination Committee (CGEWCC), functioning in respective states, from another list of 12 occasions. In addition, individual employees are allowed two restricted holidays in a year to be selected from a notified list of such Restricted Holidays.

In view of the ceiling on the total number of holidays that can be declared in a year by the Government, it has not been found possible to declare additional Restricted Holiday for the above occasions.

As per policy, the Central Government Employees Welfare Coordination Committee in the State Capitals choose three holidays keeping in view the occasions of local importance. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance.

This was stated by the Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh in a written reply to a question by Shri K. Bhabananda Singh in the Rajya Sabha today.

Reservation for sportspersons in services

As per extant instructions, Ministries and Departments can recruit meritorious sportspersons to Group ‘C’ posts under the Government of India up to 5% of the vacancies in any year subject to the condition that these including all other reservations do not exceed 50% of the total number of vacancies proposed to be filled up by direct recruitment.

Consolidated instructions on incentives for sportspersons including recruitment under sports quota have been issued vide Department of Personnel and Training’s OM No 14034/01/2013-Estt.(D) dated 3rd October 2013. At present no proposal to increase the quota is under consideration of the Government.Reservation for sportspersons in Government Services

Department of Personnel and Training (DoPT) lays down the policy for recruitment of meritorious sportspersons which is implemented by the administrative Ministries/Departments. The details regarding number of sportspersons recruited by various Ministries/Departments are not Centrally maintained.

As per extant instructions 43 sports disciplines have been identified for appointment of meritorious sportspersons. These instructions inter alia provide relaxation in upper age limit upto a maximum of 5 years (10 years in case of those belonging to Scheduled Castes and Scheduled Tribes) for the recruitment of meritorious sportspersons to Group ‘C’ posts. Government servants with medal winning performance in specified sports events are also eligible for out of turn promotion.

This was stated by the Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh in a written reply to a question by Shri Parimal Nathwani in the Rajya Sabha today.

Sub: Brief of the Meeting of Standing Committee of National Council (JCM) held today with the Additional Secretary, Department of Expenditure

A meeting of the Standing Committee of National Council(JCM) with the Additional Secretary, Department of Expenditure, has taken place today to discuss about the issues arising after the implementation of the 7th CPC recommendations.

At the beginning of the meeting: the Official Side briefed about the decision taken by the Government on the Allowances. The Staff Side thereafter raised the following issues:-

1. The Central Government Employees are dissatisfied by the decision taken by the Government not to revised the HRA percentage recommended by 7th CPC. The demand of the Staff Side is reiterated for retaining the existing percentage of 30%, 20% and 10%.

2. The low paid employees who were getting Transport Allowance @ Rs.3600 + DA a on 1.1.2016 is subject to huge financial loss since their Transport Allowance has been reduced to Rs.1300+DA. This injustice should be rectified. Official Side agreed for a review.Allowances should be Implemented w.e.f. 25.7.2016

3. Even though the demand of the Staff Side is that, Allowances should also be revised from the date of revision of pay i.e.1.1.2016, at least Government should have given the same from the date of notification of 7th CPC as was done during the previous pay commissions. The Official Side is requested to consider this demand. The Staff Side also drawn attention of the Official Side towards the Awards given by the Board of Arbitration in favour of the employees in the past in the regard.

4. As regards Minimum Pay Fitment Formula, the Staff Side has already submitted the justification for increasing Minimum Pay and Fitment Factor. However, Official Side has not yet responded till date on this demand. Since Minimum Pay is not derived on the basis of Dr.Akryod Formula / 15th ILC norms and Supreme Court judgement, the issue requires the review by the Government. Morever, even in the existing Pay Matrix there is discrimination between the low paid employees and high paid officers. Therefore, this demand should be discussed with the Staff Side by the Official Side so as to settle this major issue which was agreed to be considered by the Group of Ministers.

5. Government may restore various advances withdrawn and should also issue orders for revision of HBA as recommended by 7th CPC and accepted by the Cabinet.

6. While thanking the government for restoring Risk Allowance to the Defence Civilian Employees, the revised rate is very negligible. It should be at least at par with the Risk Matrix given to the Fire fighting Staff.

7. Staff Side, while thanking the government for restoration of some of the allowances, abolished/subsumed by the 7th CPC, asked the Finance Ministry to remove the barrier of coming back to Finance Ministry in case of 12 allowances meant for the Running Staff of the Indian Railways, being bilateral settlement with the Railway Ministry.

The Staff Side informed the Chairman that, considering the discontentment prevailing amongst the Central Government Employees, the Official Side may convey the feelings of the Staff Side to the Government on the above issues, and in case if ther is no positive approach from the Government, then there will be alternative than to plunge into Action Programmes.

The chairman, after a patient hearing, responded as follows :-

1. The views expressed by the Staff Side would be conveyed to the Government.

2. As regards, Minimum Pay and Fitment Factor, the Staff Side may give additional grounds and justification for any revision, so that the Official Side can consider the same.

3. After receipt of the above note from the Staff Side, the next meeting would be convened.

NCJCM Standing Committee has reiterated the Government to retain HRA at 30%,20% and 10% in the Meeting of Standing Committee of National Council (JCM) held today with the Additional Secretary, Department of Expenditure. And other issues like Transport Allowances is reduced for Level 1 and 2 , Fitment factor and Minimum Wage also discussed in the Meeting.

The following demands were made in the above Meeting

Retain HRA at Existing rates of 30% , 20% and 10%

Those who are paid Transport Allowance @ 3600 as on 1.1.2016 in Level 1 and 2 has been reduced to RS.1350+DA. This injustice to be rectified

Allowances are at least implemented with effect from the date of Notification of 7th CPC

Decision on Minimum wage and Fitment Factor to be reviewed and it should be derived on the basis of Dr.Akryod Formula / 15th ILC norms and Supreme Court judgement

Advances to be restored again

Revise the HBA as recommended by 7th CPC and accepted by the Cabinet

Risk Allowance should be revised at par with the Risk Matrix given to the Fire fighting Staff.

 As this Meeting is an important Official Meeting between Staff side and the Government of India, the demands mentioned above will be taken into account for consideration. The Chairman of the Meeting has also assured that the issues of  Minimum Pay and Fitment Factor will be considered after the Staff Side gives additional grounds and justification for any revision.

Sub: Grant of Extra Work Allowance- (abolition of existing Caretaking Allowance, Extra Duty Allowance, Flag Station Allowance, Flight Charge Certificate Allowance, Library Allowance, Rajbhasha Allowance and Special Appointment Allowance) – decision of the Government on the recommendation of the Seventh Central Pay Commission (7th CPC).

The undersigned is directed to say that the decisions of the Government on various allowances based on the recommendations of the 7th Central Pay Commission and in the light of the recommendations of the Committee under the Chairmanship of Finance Secretary have since been notified vide Resolution No.11-1/2016-IC, dated 6th July, 2017.Extra Work Allowance  

2. As mentioned in the Appendix-Il of the said Resolution, dated 6th July, 2017, the existing allowances viz. Caretaking Allowance (Sl. No. 22 of Appendix-Il, as at present governed under this Department’s 0M No.7(21)/2008/E.lllA dated 22.9.2008), Extra Duty Allowance (Sl. No. 57 of Appendix-Il), Flag Station Allowance (Sl. No. 64 of Appendix-Il), Flight Charge Certificate Allowance (Sl. No. 650f Appendix-Il), Library Allowance (Sl. No. 100 of Appendix-Il), Rajbhasha Allowance (Sl. No. 136 of Appendix-Il) and Special Appointment Allowance (Sl. No. 157 of Appendix-Il) have been abolished as a separate allowance and the eligible employees are now to be governed by the newly proposed Extra Work Allowance.

3. Accordingly, the above allowances shall stand abolished and the President is pleased to decide that the eligible employees shall now be covered under a new Extra Work Allowance which shall be governed as under:

a) Extra Work Allowance will be paid at a uniform rate of 2% (two percent) of the basic pay per month.

b) An employee shall receive this allowance for a maximum period of one year, and there should be minimum gap of one year before the same employee is deployed for similar duties again.

c) This allowance shall not be combined i.e. if the same employee is performing two or more such duties and is eligible for 2% (two percent) allowance for each add-on, then the total Extra Work Allowance payabale will remain capped at 2% (two percent) of basic pay.

4. In respect of the existing Special Appointment Allowance, which stands abolished, apart from the existing eligible employees, Assistant Sub-inspector (Radio Mechanic), Assistant Sub Inspector (Radio Operator) and Sub Inspector (Radio Mechanic) are also to be included in the list eligible for Extra Wok Allowance at the rate of 2% of Basic Pay per month with the conditions recommended by the 7th CPC.

5. These orders shall effective from 1 st July, 2017.

6. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issues after consultation with the Comptroller & Auditor General of India.

Central Secretariat Manual of Office Procedure (CSMOP) lays down broad procedures for process management in the Central Secretariat. The CSMOP does not contain any provision for initiating disciplinary action against an official for non-compliance of procedure laid down in the CSMOP. It is for the concerned Central Secretariat office to take action against its officials, under the relevant Conduct Rules of service. Information relating to disciplinary action taken by Central Government offices against their officials for not following the procedure of CSMOP is not centrally maintained.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State for Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Dr. Anupam Hazra in the Lok Sabha today.

As per information available as on 24th July, 2017, 18 States and 7 Union Territories have discontinued the practice of interview in recruitment for lower level posts.

The objective of discontinuation of interview in selection process at lower level posts is to curb corruption, more objective selection in transparent manner and substantially easing the problems of poor aspirants. Union Territory Administration of Daman & Diu has informed that it has benefitted them economically by way of savings on account of non-application of Travelling Allowance/ Daily Allowance and other expenditure involved in calling candidates for interview. Further, Union Territory Administration of Lakshadweep has informed that local aspirants have economically benefited from this initiative of the Government.Scrapping of Interview in Recruitment for Lower Level Posts

The States of Arunachal Pradesh, Jammu & Kashmir, Haryana, Mizoram, Tripura, Uttar Pradesh and West Bengal are yet to decide about discontinuation of interview in the recruitment of lower level posts. The States of Sikkim and Meghalaya have not adopted the process of discontinuation of interviews in recruitment to lower level posts. However, information regarding the State of Nagaland is not available. Further, it has been informed by the State of Odisha that steps have already been taken to implement scrapping of interview system concerning junior level posts (Group B & C) of all Departments.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State for Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Naranbhai Kachhadiya in the Lok Sabha today.

The vacant posts in Government Ministries/Departments are required to be filled as per the Recruitment Rules for the post. Information related to recruitment of staff by Government of India is not centrally maintained.

Recruitment to various posts in Government of India is made through various recruitment agencies constituted for the purpose such as Union Public Service Commission, Staff Selection Commission etc. Recruitment agencies conduct examinations based on indents received from various Ministries/Departments/offices of Government of India. Ministries/Departments and the recruitment agencies have been sensitized to take all the required steps for filling up of the posts.

The Government is always committed to appoint best available talent subject to provisions of rules. NITI Aayog in the Three Year Action Agenda for 2017-2020 has recommended for inducting specialists into the system through lateral entry in policy making areas on fixed term contract. This recommendation along with suggestions received from other quarters are under consideration.
