GUIDELINES FOR CLAIMING REIMBURSEMENT OF MEDICINES PURCHASED FROM 23 MAR 2020 ONWARDS
 
1. Please ref the fwg -:-

2. Though the lockdown may be lifted after 31 May 2020 in a gradual manner, in view of the prevalent situation, it is critical to ensure minimum footfall at the Polyclinic to mitigate spread of virus.

3. In view of the above, provisions have been granted to purchase life style/ chronic diseases medicines and claim reimbursement by veterans till 31 May 2020. Individual medicines reimbursement bills are normally handed over physically to OIC Polyclinic for processing for payment. However to minimise/ stream line footfall at Polyclinics, provision to upload bills online or send by Registered Post may be resorted to. Beneficiaries may be advised to follow one of the three methods elucidated in succeeding paras for reimbursement of claim amount with immediate effect :-

(a) Online Submission.

(i) Veterans may submit claims online through designated email to OIC Polyclinic A separate mail ID may be created by OsIC PC. if required for the purpose and informed to veterans.

(ii) The scanned copies of last prescription held, bill, ECHS card, contingent bill (as per Appx ‘A’ to this letter) and copy of cancelled cheque /first page of passbook should be attached as file (s) with the email.

(iii) All Veterans will mention their complete residential address and tele/ mobile No.

(iv) OIC Polyclinic will ack the receipt of mail and seek any further Clarification if required.

(v) The veterans will however submit all original documents (for audit) after the lockdown is lifted by dates to be stipulated later. Non depositing of all the original documents by stipulated date will invite recovery of money.
 
(b) Veterans who are not able to upload the claim online may send all the above documents (bill and contingent bill in original) alongwith their calling No/ whatsapp No and residential address to OIC Polyclinic through “Registered Post with Acknowledgement Due (AD) Card”. They should keep a photocopy of all documents with them. OIC Polyclinics will process the bills for payment as per existing orders.

(c) The veterans who are not able to send the online claim or by Regd Post for reimbursement shall submit their bills physically after 15 Jun 2020. Specific dates on which veterans could come to submit claims will be coordinated by OIC Polyclinic through tele, email or whatsapp.

(d) OsiC Polyclinics will process the bills (submitted online) digitally duly authenticated by DSC online and for rest of bills as per procedure explained in our letter at Para 1(a) & (b) above. RC will make necessary payment, without waiting for physical copies. Physical copies (for bills submitted online) will be fwd once situation stabilizes for audit purpose.

​On call of Central Trade Unions and Confederation of Central Government Employees and Workers, Nationwide One day protest demonstration. On 22nd May 2020 was organised throughout the Country to oppose the policy of govt. to change the labour laws, freezing of DA and DR of employees and pensioners, corporatisation and privatization of Public Sector Enterprises including Ordinance Factories of Defence.
​This program was organised in Allahabad (U.P.) also under leadership of Comrade Subhash Chandra Pandey, Ex. Assistant General Secretary, Confederation and Working President COC UP maintaining all norms and advisories issued by MHA , Health Ministry and DOPT. During demonstration Social Distance was also maintained.
​But it is a matter of great regret that a Police FIR has been lodged at Allahabad against Comrade Subhash Chandra Pandey, Shri Anugrah Narayan Singh Ex. MLA , Comrade Pramod Kumar Mishra, AGS All India Audit And Accounts Association and ten other Trade Union Leaders.
​We as Confederation of Central Govt. Employees and Workers condemned this antiworker act of UP Govt. and demand immediate   withdrawal of FIR against the leaders mentioned therein.

For claiming child education allowance/Hotel Subsidy for the year 2019- 2020 following instruction are to be followed in Mumbai division.

(1) Employees have to fill form of CEA/Hostel Allowance in E/KARMIK.

(2) As per para 2(b) of RBE NO. 114/2018, in order to claim reimbursement of CEA, employee should produce a certificate issued by the head of the institution for the period for which claim has been preferred. The certificate should confirm that the child studied in the school during the previous academic year. In such cases, where certificate cannot be obtained, self-attested copy of the report card or self-attested fee receipt(s) including e-receipts confirming/indicating that the fee deposited for the entire academic year can be produce as a supporting document to claim CEA. The period here means academic year i.e. twelve months of complete academic session.

(3) Necessary documents like Bonafide certificate/ fees receipt/report card (as per para-2), Family particulars, to be uploaded in E/KARMIK along with form. (attachment should be compulsory)

(4) As per para 2(c) of RBE NO. 114/2018, For claiming Hostel Subsidy, a similar certificate from the head of the institution confirming that child studied in the school will suffice, with additional requirements that the certificate should mention the amount of expenditure incurred by employees towards lodging and boarding in the residential complex. In such case certificate cannot be obtained, self-attested copy of report card and original fee receipt(s)/ e-receipt(s) which should indicate that amount of expenditure incurred by the employee towards lodging and boarding in the residential complex can be produce for claiming hostel subsidy. The expenditure on lodging and boarding or the ceiling of RS. 6750/- whichever is lower shall be paid to the employee as hostel subsidy.

(5) Original bonafide certificate/ fees receipt/report card (as per para¬2), for claiming CEA and hostel subsidy to be submitted by the employees, on demand from administration.

Sub: Preventive Measures to contain the spread of COVID-19 – Officials residing at Containment Zone/ suffering from Covid related symptoms.

Attention is invited to Office Orders No 32 & 33 of 2020 containing instructions regarding reporting of Officials in Board’s Office during lock down period. In these instructions it has been advised that Officials residing in Containment Zones as demarcated by states/district administration will not attend Office.

2. Officials who are residing in containment zones / or suffering from any flu/Covid related symptoms are therefore advised to submit a ‘self declaration’ to this effect to their reporting Officers concerned and G/Acc branch. The concerned Branch in charge may also review the status in respect of their branches/Directorates.

3. All Controlling Officers may ensure the above and closely monitor the status of Officials working in their respective Directorates on daily basis as precautionary measures to prevent the spread of Corona virus in Board’s Office. Further, the Controlling Officers may also inform the administration immediately upon coming to know about any of their Officials suffering from Covid related symptoms or are reporting to office from containment zones. Suitable directive may be issued to subordinate officials in this regard.

4 Strict compliance of above instructions is solicited by all concerned.

Subject: Clarifications in respect of prescribed electronic modes under section 269SU of the Income-tax Act 1961 – reg.

In furtherance to the declared policy objective of the Government to encourage digital transactions and move towards a less-cash economy, a new provision namely Section 269SU was inserted in the Income-tax Act, 1961 (“the Act”), vide the Finance (No. 2) Act 2019. This section requires every person carrying on business and having sales/turnover/gross receipts from business of more than Rs 50 Crores (“specified person’) in the immediately preceding previous year to mandatorily provide facilities for accepting payments through prescribed electronic modes. Subsequently vide notification no. 105/2019 dated 30.12.2019 (i) Debit Card powered by RuPay; (ii) Unified Payments Interface (UPI) (BHIM-UP]); and (iii) Unified Payments Interface Quick Response Code (UPI QR Code) (BHIM-UPI QR Code) were notified as prescribed electronic modes.

2. Representations have been received stating that the above requirement of mandatory facility for payments through the prescribed electronic modes is generally applicable in B2C (Business to Consumer) businesses, which directly deal with retail customers. Moreover, since the prescribed electronic modes have a maximum payment limit per transaction or per day they are not so relevant to B2B (Business to Business) businesses, which generally receive large payments through other electronic modes of payment such as NEFT or RTGS. Mandating such businesses to provide the facility for accepting payments through prescribed electronic modes would cause administrative inconvenience and impose additional costs.

3. In view of the above, it is hereby clarificd that the provisions of section 269SU of the Act shall not be applicable to a specified person having only B2B transactions (i.e. no transaction with retail customer/consumer) if at least 95% of aggregate of all amounts received during the previous year, including amount received for sales, turnover or gross receipts, are by modes other than cash.

Madam/Sir,
The undersigned is directed to inform that vide O.M. No. 3/3/2019-NS (Pt.1) dated 21.05.2020, the MoF (DEA) has decided to relax some regulatory provisions to safeguard the interest of Small Savings Depositors in view of the lockdown in the country due to COVID-19 pandemic.


2. Accordingly the following relaxation guidelines in reference to Sr. Citizen Savings Scheme (SCSS) are issued with immediate effect regarding –

a. Individual retired (within the age bracket 55-60 years) on Superannuation or otherwise and got retirement benefits in February-2020, March-2020 and April-2020 are eligible to open SCSS account up to 30th June, 2020.

b. Personnel from Defence Services retired and got retirement benefits in February-2020, March-2020 and April-2020 are also eligible to open SCSS account up to 30% June, 2020 under the prescribed eligibility conditions applicable to them.
3. It is requested to circulate it to all concerned for information and necessary action. The same may also be placed on the notice boards of the Post Offices in public area.

4. This issues with the approval of Competent Authority.

Sub : Communication through e-mail

The Indian Railways Information and Communication Technology (IR ICT) Security Policy, 2019 details the information security policy that all IR units shall observe and follow. Section 17 of the Policy defines the acceptable e-mail usage in official working in sync with the Government of India’s (Gol) e-mail policy.
 
2. In pursuance of the same, it is brought to notice of all concerned that only the e-mail services of GoI 1.e. @gov.in/@nic.in domain should be used for all official communications. This email service is secure with Geo-fencing feature (country-wise access control). No official communication (email) should be entered into using the e-mail @ services provided by other service providers.

3. In order to ensure un-interrupted services and also for security reasons, updation of current mobile numbers under the personal profile of users is mandatory for security reasons. The number would be used only for sending alerts and information, if any, regarding security. Auto-save of password in the e-mail service should not be resorted to for security reasons. Sharing of a user’s password with others is also strictly prohibited.

4. Public Sector Enterprises, under the administrative control of Ministry of Railways, are expected to use their corporate email accounts hosted on their servers located in India for all official communications.

5. In order to disseminate information for all users of IR network, a website : cert-rail.railnet.gov.in – has been hosted which contains best practices to be followed while using IT assets, various policy documents of Gol including the IR ICT security policy, advisories issued from time to time by various agencies of Gol, etc.
 
6. In view of the foregoing, all are requested to adhere to these instructions and all
official communications over email should only be entertained and/or entered into
through the official [@ |gov[dot]in / [@]nic[dotl]in.

Sub: Freezing of Dearness Allowance to Central Government Employees and Dearness Relief to Central Government Pensioners – Hardships & legal implications thereof.

This is in continuation of our earlier memorandum cited above regarding unjust decision taken by the Government to freeze the rates of DA and DR up to July 2021, over-riding earlier decision of the Union Cabinet to grant 4% additional DA and DR from 01.01.2020, and arbitrarily changed Cabinet decision through an executive order of the MoF(DoE) vide its O.M. dated 23.04.2020 by Freezing DA and DR as on January 1, 2020. This had put the Central Government employees and Central Government Pensioners in severe hardship. Cost escalation of Essential Commodities, in the wake of Coviod-19 crisis period, has further aggravated stressful situation.


We submit the following points for your consideration:-

Hon’ble Finance Ministerhas recently announced series of financial boost-ups for Rs.20.97 lakh crores as stimulus under “Atmnirbhar Bharat Package” covering certain sectors to boost economic activities.

As a result of above mentioned economic packages, the business and rich sections of the society got motivational packages, in one form or the other, except the workers, poor people, Government Employees and Pensioners, who have to bear the brunt of the COVID-19 lockdown and its severe impact on the inflation and consequential price rise of all commodities. Instead of providing some relief to them to meet with the higher inflation, it is regrettable that, inspite of the protests by the JCM Staff Side, vide its letter cited above, the Government has not yet withdrawn its orders of 23.04.2020 to freeze DA and DR rates as on 01.01.2020 upto July 2021 and not to pay the arrears for the three installments of additional DA and DR falling due from 01.01.2020, 01.07.2020 and 01.01.2021. This has adversely affected the morale of the Employees and Pensioners, besides causing serious hardship to them and their families, especially from the lower and middle income groups.

DA and DR are the part of Pay and Pension respectively. DA and DR provide protection against erosion of Wages and Pension due to price rise and inflation. DA and DR are having great importance in wage structure for the Central Government Employees and Pensioners. All Central Pay Commissions decided pay structure by merging DA and DR with the Pay and Pension, treating them as zero from the date of implementation of its report and linking them with the revised base of Price Index from the said date of implementation of its recommendations. Subsequent rise in DA and DR installments are being released to compensate the inflation there-onwards.

The First Central Pay Commission (1946-48) recommended that, “As long as cost of living is continued to be substantially higher, some system of dearness allowance over and above pay must continue in operation”. Thereafter, every Central Pay Commissions recommended grant of DA and DR to compensate for inflation.
 
Third Pay Commission onwards all the Central Pay Commissions had recommended for Revision of DA and DR every six months as per percentage rise of Price Index over the base point on the date of implementation of the respective CPCs.

Moreover, DA and DR is linked with the Consumer Price Index, as already accepted by the Government, cannot be freezed.

DA and DR is the Fundamental Right of an Employee and Pensioner respectively, therefore, withholding this Compensation Package, meant for sustenance against price rise, is unacceptable under any circumstances. The government should take note that, DA and DR provision is meant to facilitate survival of the Employee and Pensioner against erosion of Wages and Pension.

In its recommendations, vide Para 8.17.37, the 7th CPC continued the same formula of revision of DA and DR every 6 months from 1st January and 1st July.The recommendations of the 7th Pay Commission were accepted by the Union Cabinet. The samecannot be changed or taken away unilaterally through an executive order.

Fair Wages Committee recommended that, “It is clearly necessary for this country to continue to pay dearness allowance to neutralize wholly or atleast substantially the increase in the cost of living”.

Payment of Salary/Pension and DA or DR thereon to an employee and Pensioner are not a matter of bounty. It is a vested right of an employee and a Pensioner to receive the salary and Pension(Pension is a deferred wage as held by the Apex Court in DS Nakara’s Case and Major General SPS Bain’s case). DA and DR are part of Salary and Pension. It is also a statutory right as it flows from the Service Rules. Right to receive Salary and Pension every month is part of the service conditions emanating from Article 309 of the Constitution of India.

In the case of State of MP Vs. Ranojirao Shinde [AIR (1968) SC 1053], it has been held that, right to a sum of money is ‘property’. In the decision in Deokinandan Prasad Vs. State of Bihar & Others [AIR 1971 SC 1409], it has been held that, right to receive pension is a property and the same cannot be taken away or withheld by a mere executive order.

Freezing of Dearness Allowance and Dearness Relief is a blatant violation of the provision of Article 360 of the Constitution of India.

Article 300A of the Constitution of India, which confers a Constitutional Right to Property, includes within its purview, salary as a right to property and as a sequel thereof, it applies to Pension and the DA and DR thereon.

It is pertinent to mention that, neither Epidemic Diseases Act 1897 nor Disaster Management Act 2005 specify or confer any power upon any Government to defer the Salary or Allowances due to its Employees and Pensioners. DA and DR cannot be denied under any circumstances.

As per Settled Law, financial difficulty is not a ground for the Government to defer or freeze the Payment of Salary/Allowances or Pension by an executive order.

It is, therefore,requested that, the O.M. dated 23.04.2020 of the Department of Expenditure, for freezing of Dearness Allowance and Dearness Relief to the Central Government Employees and Pensioners, may please be withdrawn and arrears of Additional DA and DR @ 4% w.e.f. 01.01.2020 may please be paid at the earliest as per decision of the Union Cabinet taken prior to the said O.M. on freezing of DA and DR.

In conclusion, I would like to add that, like other employees, the Central Government Employees are also equally subjected to undue hardship due to COVID-19 epedemic, and the resultant economic downfall. Many economic demands of the Central Government Employees, including the ones which are approved by the Union Cabinet, are also remaining unimplemented since Government orders are not issued, especially on revision of Night Duty Allowance and Risk Allowance on 7th CPC pay scales, and 7th CPC anomalies, including assurance given by the Group of Ministers during Strike Demand Negotiations, are all remaining unsettled. In this situation freezing DA/DR for 18 months and not paying the arrears is not at all a justified decision. As many prominent economists have suggested to the Government that, money should be given to the people, to improve liquidity and purchasing power in the market, may be considered by the Government in its true spirit, and, therefore, I once again request you to kindly bring all the above justifications for releasing Additional DA/DR to the notice of the Hon’ble Prime Minister, and a favourable decision may be taken in this regard, considering the fact that, a good number of Government Employees are working during the entire lockdown period, taking risk of not only their life, but also their family members.

Consumer Price Index for Industrial Workers (CPI-IW) – April, 2020

The All-India CPI-IW for April, 2020 increased by 3 points and stood at 329 (three hundred and twenty nine). On 1-month percentage change, it increased by (+) 0.92 per cent between March and April, 2020 compared to (+) 0.97 per cent increase between corresponding months of previous year.


The maximum upward pressure in current index came from Food group contributing (+) 2.43 percentage points to the total change. At item level, Rice, Wheat, Wheat Atta, Arhar Dal, Moong Dal, Mustard Oil, Fish Fresh, Goat Meat, Poultry (Chicken), Brinjal, Cabbage, Cauliflower, French Bean, Green Coriander Leaves, Lady’s Finger, Palak, Potato, Radish, Tomato, Banana, Lemon, Mango (Ripe), Sugar, Cooking Gas, etc. are responsible for the increase in index. However, this increase was checked by Garlic, Onion, Parval, Petrol, Flowers/Flower Garlands, etc., putting downward pressure on the index.

Year-on-year inflation based on all-items stood at 5.45 per cent for April, 2020 as compared to 5.50 per cent for the previous month and 8.33 per cent during the corresponding month of the previous year. Similarly, Food inflation stood at 6.56 per cent against 6.67 per cent of the previous month and 4.92 per cent during the corresponding month an year ago.

At centre level, Doom-Dooma Tinsukia recorded the maximum increase of 14 points followed by Salem (12 points) and Surat (10 points). Among others, 9 points increase was observed in 2 centres, 8 points in another 2 centres, 7 points in 3 centres, 6 points in 2 centres, 5 points in 5 centres, 4 points in another 5 centres, 3 points in 11 centres, 2 points in 10 centres and 1 point in 18 centres. On the contrary, Chhindwara, Vadodara, Bhilai, Yamunanagar and Jamshedpur recorded a decrease of 1 point each. Rest of 12 centres’ indices remained stationary.

The indices of 33 centres are above All-India Index and 44 centres’ indices are below national average. The index of Rourkela centre remained at par with All-India Index.

The next issue of CPI-IW for the month of May, 2020 will be released on Tuesday 30th June, 2020. The same will also be available on the office website www.labourbureaunew.gov.in.

After releasing the AICPIN for the month of April 2020, the next stage of expected DA calculation is completed!

Even though the additional dearness allowance is frozen for 18 months from January 2020 to June 2021 to all Central government employees and pensioners, the calculation of Dearness allowance is an ongoing process! As per the press release of the AICPIN for the month of April 2020, the index is increased by three points from its existing level. Now, the AICPIN is standing at 329.

Subject: Order of Hon’ble Supreme Court of India dated 05.03.2020 in SLP (C) No.21803/2014 UoI Vs. M.V. Mohanan Nair & Ors. regarding benefits in promotional hierarchy under MACP Scheme – other issues arising out of Order dated 05.03.2020 -regarding.

The undersigned is directed to refer to this Department’ s O.M. of even number dated 23.03.2020, which was issued as per Order dated 05.03.2020 of the Hon’ble Supreme Court of India in SLP (C) No.21803/2014, UoI Vs. M.V. Mohanan Nair & Others wherein the Hon’ble Apex Court had held that benefits under the Modified Assured Career Progression Scheme (MACPS) cannot be granted in the promotional hierarchy, and that it would be in the standard hierarchy of Grade Pay/Pay Levels in the Pay Matrix as per the existing MACP guidelines.

2. The Hon’ble Apex Court, in para 53 of aforementioned Order dated 05.03.2020, further directed that some anomalies, which were brought before the Joint Committee, constituted in Department of Personnel & Training (DoP&T) to examine the MACPS, as indicated in paras 47 to SO of the Order dated 05.03.2020, be considered as deemed appropriate, and a decision taken in accordance with law.

3. Accordingly, in compliance of the directions of Hon’ble Apex Court, as indicated in paras 47 to 50 of the Order dated 05.03.2020, the issues arising out of deliberations of the Joint Committee constituted to examine the MACP Scheme, and which were not finally disposed of, have been examined in consultation with Department of Expenditure. It is also to be noted that revised guidelines on MACPS, as per recommendations of the 7th CPC, have been issued vide DoP&T’s OM No.35034/3/2015-Estt.(D) dated 22.10.2019.

Consumer Price Index for Industrial Workers (2016=100) – March 2021

The Labour Bureau, an attached office of the M/o Labour & Employment, has been compiling Consumer Price Index for Industrial Workers every month on the basis of retail prices collected from 317 markets spread over 88 industrially important centres in the country. The index is compiled for 88 centres and All-India and is released on the last working day of succeeding month. The index for the month of March 2021 is being released in this press release.

The All-India CPI-IW for March 2021 increased by 0.6 points and stood at 119.6 (one hundred nineteen and point six). On 1-month percentage change, it increased by 0.50 per cent with respect to previous month whereas there was a decline of 0.61 per cent between corresponding months a year ago.

The maximum upward pressure in current index came from Fuel & Light group contributing 0.40 percentage points to the total change. It was further supplemented by Miscellaneous group contributing 0.15 percentage points to the total rise. At item level, Cooking Gas, Petrol, Poultry Chicken, Edible Oils, Apple, Orange, Tea Leaf, Served & Processed Packaged Food, etc. are responsible for the rise in index. However, this increase was mostly checked by vegetables putting downward pressure on the index.

At centre level, Jamshedpur and Sangrur recorded maximum increase of 3.0 points each. Among others, 4 centres observed an increase between 2 to 2.9 points, 22 centres between 1 to 1.9 points and 45 centres between 0 to 0.9 points. On the contrary, Doom-Dooma Tinsukia recorded a maximum decrease of 3.2 points. Among others, 2 centres observed a decline between 2.0 to 2.9 points, another 2 centres between 1 to 1.9 points and remaining 10 centres between 0 to 0.9 points.

Year-on-year inflation for the month stood at 5.64 per cent compared to 4.48 per cent for the previous month and 5.50 per cent during the corresponding month of the previous year. Similarly, Food inflation stood at 5.36 per cent against 4.64 per cent of the previous month and 6.67 per cent during the corresponding month a year ago.

After releasing the AICPIN for the month of March 2021 the AICPIN date is decreased by 0.6 points and stood at 119.6 (one hundred nineteen and point six). 

When will revoke Freezing of DA for CG Employees?

The three instalments of additional DA (Jan 2020, Jul 2020, and Jan 2021) will be resumed from July 2021. The assumption of DA percentage for the month of Jan 2020, Jul 2020, and Jan 2021 are given below with an example.

Including three instalments of additional DA and DR to be added with the July 2021 DA and DR. 

  • 1st January 2020: 21% (17% + 4%)
  • 1st July 2020: 24% (21% + 3%)
  • 1st January 2021: 28% (24% + 4%)
  • 1st July 2021: 31% (Expected)
Total additional DA and DR from July 2021: 17%+ 4%+3%+4%+3%

1st July 2021: 3% + 28% = 31% (Expected)
