Small Committee Meeting held at Mumbai at IBA Office on 18/08/2018

A small committee meeting of Officers’Associations with IBA was held today at IBA Office, World Trade Centre, Cuffe Parade, Mumbai at 10-30 AM. The IBA team was led by Shri Prashant Kumar(DMD, SBI), Shri B. Ashok(GM, CBI), Shri Ujjwal Kumar(GM, UCO Bank), Shri LVR Prasad(GM, Canara Bank), Shri Raj Kiran Bhoir(GM, Bank of Maharashtra), Shri B Rajkumar(Dy C.E.O IBA)), Shri S.K. Kakkar(Sr. Vice President, HR & lR, IBA), Shri K.S. Chauhan, Advisor (HR & lR) and other officials of HR Dept. lBA. The four Officer organizations were represented by Com. Dilip Saha, Com Soumya Datta(AIBOC), Com S Nagarajan(AIBOA), Com K.K. Nair(INBOC) and Com. V Tikekar(NOBO) in the discussion.

On our charter of Demands containing both ” Monetary and Non- Monetary” issues, elaborate discussions were held. On matters of issues having linkage of financial bearings, no finality could be arrived at in this meeting. However, on certain issues, they have agreed to place the issues before HR Committee of IBA for appropriate finalization. The IBA has responded positively to our request for convening an exclusive meeting on “Discipline and Appeal Regulations”. On certain issues, notes are to be submitted by us within a time bound manner preferably in a week’s time. We shall provide updates on further development.

Subject: Revision of Entitlement of TA/DA to JCM Members after implementation of Seventh CPC recommendations.

The undersigned is directed to say that consequent upon the revision of rates of Travelling Allowance/Daily Allowance by the Department of Expenditure vide O.M. No. 19030/1/2017-E.IV dated 13/07/2017, the Staff Side Members of the National Council (NC)/Departmental Councils and Third Level/Regional Councils of JCM shall be entitled to TA/DA etc. in the following manner w.e.f. 01.07.2017.

A. National/Departmental Council JCM TA/DA entitlement as admissible to officers in Pay level 12 & 13 as per Department of Expenditure’s O.M. No. 19030 /1/2017-E.IV dated 13/07/2017 as under:

(i) Travel entitlement within the country – Economy class by Air or AC-I Class by Train including travel in Premium /Premium Tatkal /Suvidha/Shatabdi / Rajdhani Trains.

(ii) Reimbursement for Hotel Accommodation of upto Rs. 4500/- per day.

(iii) Reimbursement of food bills not exceeding Rs.1000/- per day.

(iv) Reimbursement of AC Taxi Charges of upto 50 kms per day.

B. Regional/ Office Council (JCM) TA/DA entitlement as admissible to officers in Pay level 11 as per Department of Expenditure’s O.M. No. 19030 /1/2017-E.IV dated 13/07/2017 as under :

(i) Travel entitlement within the country – Economy Class by Air or AC-II Class including Rajdhani/ Shatabdi Express etc.

(ii) Reimbursement for Hotel Accommodation of upto Rs. 2250/- per day.

(iii) Reimbursement of food bills not exceeding Rs. 900/- per day.

(iv) Reimbursement of non-AC taxi charges of up-to Rs. 338/- per day for travel within the city

2. The admissibility of DA in case of free boarding and lodging, has been considered in Department of Expenditure. Daily Allowance is given to the Govt. employees as a reimbursement of the expenditure incurred by him on tour for his stay, food and travel at that station. In case of free boarding and lodging, the Govt. employee, if incurring any expenditure on local travel, can claim the same as per Para 2 E(i) and (iii) of the Annexure to OM No.19030/1/2017 E.IV dated 13.07.2017. The earlier system of giving 25% of DA has been discontinued. Also after implementation of 7th CPC recommendations, the facility of DA at 5th CPC rates is done away with.

3. This O.M. is issued with concurrence of the Ministry of Finance, Department of Expenditure vide I.D. No.300377130/2018-E.IV dated 31.07.2018

Railway Federations (AIRF & NFIR) are yet to take a decision regarding revival of indefinite strike

NJCA MEETING – 18-08-2018
CONFEDERATION, NFPE AND AIDEF INSISTED REVIVAL OF INDEFINITE STRIKE — AUTHORIZED NJCA CHAIRMAN AND CONVENER (RAILWAY FEDERATIONS – AIRF & NFIR) TO TAKE FINAL DECISION REGARDING INDEFINITE STRIKE .

NJCA meeting was held on 18-08-2018. Government has ignored the ultimatum given by NJCA and has not given any cognizance to NJCA’s Resolution adopted on 03-07-2018 and the letter dated 03-07-2018 addressed to Cabinet Secretary.

Government has betrayed NJCA and entire Central Government employees and Pensioners. Therefore, the Representatives of Confederation, NFPE and AIDEF insisted to revive the indefinite strike and start preparations for the strike immediately, as all employees are eagerly waiting for such a decision from NJCA.

Railway Federations (AIRF & NFIR) are yet to take a decision regarding revival of indefinite strike. After discussion it was decided to authorize the Chairman & Convener of NJCA (Railway Federations – AIRF & NFIR) to take final decision and convey the same to Government and also to all constituent organizations of NJCA.

As NJCA could not take any final decision regarding strike, Confederation shall go ahead with its decision to organize one day nationwide strike on 15th November 2018. In the mean time all Central Trade Unions (other than BMS) and independent Federations (including Confederation) are holding a National Convention at New Delhi on 28th September 2018. If any decision for strike is taken in that convention, the date of the Confederation’s strike will be changed to synchronize with the date(s) of the Central Trade Unions and independent Federations, as already decided in the June 10th Hyderabad National Convention.

OFFICE MEMORANDUM

Subject:- Implementation of the recommendation of the 7th CPC – Option regarding commutation of additional amount of pension.

The undersigned is directed to state that in pursuance of Government’s decision on recommendation of 7th Central Pay Commission, orders have been issued for revision of provisions regulating pension / gratuity / commutation of pension etc. vide this Department’s OM 38/37/2016-P&PW(A) dated 04.08.2016. In para of the said OM, it has been mentioned that there will be no change in the provisions relating to commutation values, the limit upto which the pension can be commuted or the period after which the commuted pension is to be restored.

2. As per Rule 10 of CCS (Commutation of Pension) Rules, 1981, an applicant who has commuted a percentage of his final pension and after commutation his pension has been revised and enhanced retrospectively as a result of Government’s decision, the applicant shall be paid the difference between the commuted value determined with reference to enhanced pension and the commuted value already authorised. For the payment of difference, the applicant shall not be required to apply afresh.

3. References have been received in this Department that many pensioners who retired after 01.01.2016 and have drawn pension/commuted value of pension based on their pre-revised pay/pension do not wish to commute the pension which has become additionally commutable on revision of pay/pension on implementation of recommendations of 7th CPC. the matter has been examined in consultation with Ministry of Finance (Department of Expenditure), It has been decided that those pensioners who retired from 01.01.2016 till 04.08.2016 i.e. the date of issue of orders for revised pay/pension based on the recommendations of the 7th CPC may be given an option, in relaxation of Rule 10 of CCS (Commutation of Pension) Rules, 1981, not to commute the pension which has become additionally commutable on revision of pay/pension on implementation of recommendations of the 7th CPC. The Cases where the additional pension after 7th CPC has already been commuted will not be re-opened.

4. In their application to the employees of Indian Audit and Accounts Department, these orders issue in consultation with Comptroller and Auditor General of India.

5. This issues with the concurrence of Ministry of Finance, Department of Expenditure ID No.192/E.V/2016, dated 30.09.2016.

Sub: Clarification regarding grant of PCO Allowance to staff of Production Control Organization (JEs/SSEs.)

Ref.: Board’s letter No. E(P&A)I-2017/SP-1/WS-1 dated 30.08.2017.

In context of Board’s letter cited above, references have been received in Board’s office from some of the Zonal Railways, seeking clarifications regarding entitlement of PCO Allowance of JEs/SSEs drawing pay in higher pay level (i.e. level 7, 8 and 9) under MACPS rather than the pay level available for respective post. This issue has also been raised in PNM Forum by NFIR as item No. 12/2018.

2. The matter has been examined in Board’s office and it has been observed that MACPS provides for grant of Financial Upgradation to the employees on personal basis and the concerned employees continue to discharge the duties and responsibilities of the post held by them. In view of this, it is clarified that JEs/SSEs of Production Control Organisations though drawing pay in higher pay level under MACPS, are entitled for PCO Allowance at the rates prescribed for the respective post held by them with reference to their substantive basic pay drawn by the concerned JEs/SSEs in level 6 and level 7 respectively.

3.This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Following the issuance of the OM ibid, this Department has received a number of references seeking clarification on various aspects of the OM ibid. The matter has been considered in this Department in consultation with D/o Expenditure and the points of doubt are clarified as under:

1. The date of applicability of the OM ibid.
Since the OM ibid is in the context of 7th CPC Scenario, it is applicable from 01.01.2016.
2. Whether the employees who have been granted the pay fixation benefit on account of promotion between 01.01.2016 and the date of issuance of the OM ibid i.e. 27.07.2017, would be allowed to re-exercise/ revise their option for fixation of pay under FR 22(l)(a)(1).
Under the changed circumstances, after the issuance of this Department's OM ibid, the employee shall be allowed to re-exercise/ revise their option for fixation of pay under FR 22(l)(a)(1), within one month from the date of issuance of this OM. Further, the option so revised, shall be final.

2. In so far as their application to the employees belonging to the Indian Audit and Accounts Department is concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

Today Union Cabinet approved to hike 2% Additional DA & DR for CG Employees and Pensioners with effect from July 2018

Cabinet approves additional 2 percent Dearness Allowance (DA) for Central Government employees and Dearness Relief (DR) to pensioners w.e.f. 1st July, 2018

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modihas approved to release an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners w.e.f. 01.07.2018 representing an increase of 2% over the existing rate of 7% of the Basic Pay/Pension, to compensate for price rise.

The combined impact on the exchequer on account of both Dearness Allowance and Deamess Relief would be Rs.6112.20 crore per annum and Rs.4074.80 crore in the financial year 2018-19 (for a period of 08 months from July, 2018 to February, 2019).

This will benefit about 48.41 lakh Central Government employees and 62.03 lakh pensioners.

This increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.

In partial modification of this Ministry sanction letter No 12630/Tpt. Al Mov C/246/D (Mov)/17 dated 15th September, 2017 on the subject noted above, para 2(iii) of said sanction may be substituted as under:


For :–
Physically disable service personnel as mentioned in this Ministry letter No. 12198/Q Mov C/3337/D Mov dated 30.08.1979 as amended vide letter No. 12198/Q Mov C/697/D Mov dated 26.02.1980 shall continue to be paid Transport Allowance at double the normal rates, subject to fulfilment of the stipulated conditions, which shali, in no case, be less than Rs.2250/- p.m. plus applicable rates of Dearness Allowance.

REPLACED BY :-
Physically disable employees in respect of the categories viz., visually impaired, orthopaedically. handicapped, deaf and dumb/hearing impaired, spinal deformity, shall be paid Transport Allowance at double the normal rates, subject to fulfilment of the stipulated conditions, which shall, in no case, be less than Rs.2250/- p.m. plus applicable rates of Dearness Allowance.

2.These orders shall take effect from 1st July, 2017.

3. This letter issues with the concurrence of Ministry of Defence (Fin/QA) vide their U.O. No. 9(1) Fin/QA/17 (Dy. No. 386) dated 02.07.2018.

Sub Transfer of Non-gazetted staff from one Department to another Department- Delegation of powers to Divisional Railway Managers

In terms of the provisions contained in Para 231 of IREC Vol.l (Fifth Edition-1985), Divisional Railway Managers may transfer erstwhile group “D” employees Grade Pay 1800/- Level 1 (Peons, Gangmen, Khalasi, unskilled and semiskilled, etc.) from one department to another or from one Division to another.

2. The need to delegate the powers to change of department in the case of Group “C” Railway Servants has also been experienced. In the light of the above, Board have reviewed the matter and have decided to delegate the powers to Divisional Railway Managers further · so that henceforth it shall be within the competence of Divisional Railway Managers to transfer all non-gazetted Railway employees for divisional controlled cadres from one Department to another Department subject to conditions given in Board’s letter No. E(NG)l-2006/TR/18 dated 25.09.2007, being strictly followed.

3. Accordingly, the Indian Railway Establishment Code, Vol.l, (Fifth Edition-1985) is amended as per ACS No. 133 enclosed.

NJCA DECIDES TO OBSERVE “ALL INDIA DEMANDS DAY” ON 19th SEPTEMBER 2018

Dear Comrades,

NJCA has given a call to observe 19th September 2018, the 50th Anniversary day of 1968 strike of Central Govt. employees, as ALL INDIA DEMANDS DAY protesting against the betrayal of BJP – led NDA Government and demanding immediate settlement of the following three demands. NJCA has also resolved and informed the Cabinet Secretary its decision to revive the deferred indefinite strike of Central Govt employees, in case The Govt refuses to settle the demands.

Demands :-
1) Upward revision of Minimum Wage and Fitment Formula
2) Scrapping the New Contributory Pension Scheme.
3) Allow Option-1 as one of the Pension Fitment Formula.

Confederation National Secretariat calls upon all affiliated Organizations and State / District level C-O-Cs to observe “Demands Day” on 19th September 2018 (if possible, jointly with Railway & Defence Federations) through out the country by holding protest demonstrations and rallies at all centres and also in front of all offices.

Finance Ministry Clarified about Bank Holidays on Social Networks

Banks will remain open and banking activity will continue unimpeded in the first week of September

Banks will only observe holidays on Sunday, 2nd September and second Saturday, 8th September ; Monday, 3rd September is not a pan India holiday
ATMs in all States will be fully functional; Banks advised to ensure availability of sufficient cash for dispensation from ATMs

It has come to notice that a rumour is circulating in several sections of the social media that banks will be closed for 6 days in the first week of September 2018, causing undue panic among the general public.

It is hereby clarified that banks will remain open and banking activity will continue unimpeded in the first week of September. Banks will only observe holidays on Sunday, 2nd September and second Saturday, 8th September. Monday, 3rd September is not a pan India holiday and banks only in some States where a holiday is declared under the Negotiable Instruments Act, 1881 will remain closed.

Even on those days, ATMs in all States will be fully functional and there will be no impact on online banking transactions. Banks have been advised to ensure that sufficient cash is available for dispensation from ATMs. Banks will remain open on all other days.

The All India Consumer Price Index Numbers for Industrial Workers on base 2001=100 for the month of July 2018 is increased by 10 points and stands at 301.

Dearness Allowance for Central Government Employees (also Dearness Relief for Central Government Pensioners) is calculated based on All India Consumer Price Index Numbers declared by Labour Bureau under Ministry of Labour and Employment in the last day of every month.

DA and DR to existing employees and pensioners is being given twice in a year, i.e., Jan to Jun and Jul to Dec.

This year first instalment of DA and DR from January to June 2018 approved by the Cabinet Committee and waiting for Finance Ministry Notification.
